Aliens in Romania. RIGHTS AND OBLIGATIONS

ALIENS’ RIGHTS

  • The right to the general protection of persons and wealth, guaranteed by the Constitution and other laws, as well as the rights stipulated in international treaties to which Romania is a party.
  • The right to move freely and to establish one’s residence or domicile, as the case may be, anywhere on the territory of Romania.
  • The right to re-entry for the entire validity period of the residence permit.
  • Only aliens whose residence or domicile is located in Romania may be beneficiaries of social security measures taken by the state, under the same conditions as Romanian citizens.
  • Aliens to whom the Romanian Immigration Office issued a document are entitled to check the personal data in the document and, if necessary, can request the rectification or removal of inaccurate data.
  • Aliens attending the educational system at any level have unrestricted access to the educational and training activities in society.

ALIENS’ OBLIGATIONS

  • During their stay in Romania, aliens are bound to comply with the Romanian legislation.
  • Aliens cannot organize political parties or other similar organizations or groups on the Romanian territory and cannot take part in them, cannot hold public positions and titles and cannot initiate, organize or take part in demonstrations or meetings bringing prejudice to public order or national security.
  • Aliens cannot finance political parties, organizations, groups, demonstrations or meetings such as those stipulated in paragraph (2).
  • Aliens on the Romanian territory are bound to comply with the purpose for which the right to enter and, as the case may be, the right to stay on the Romanian territory was granted, not to exceed the term for which the stay was approved and to make all the efforts necessary for leaving Romania before the term expires.

RIGHTS OF RESIDENTS IN ROMANIA

  • the right to establish or change your domicile in Romania under the same conditions as Romanian citizens;
  • equal opportunities to work in Romania as Romanian citizens, without a work permit being required;
  • the same access to independent business activities and legally regulated professional activities as Romanian citizens.
  • equal opportunities to access all forms of education, including study scholarships, as Romanian citizens; general income tax deductions and tax exemptions; access to public goods and services, including housing; freedom to associate, affiliate and join a trade union or a professional organization.
  • the right to old age pension, invalidity or death benefits, even if the person in question no longer resides in Romania, under the same conditions as Romanian citizens or their heirs who no longer reside in Romania.

CONDITIONS FOR GRANTING THE PERMANENT RESIDENCE IN ROMANIA

  • continuous residence on the territory of Romania in the last five (5) years. Any period of absence must be shorter than six (6) consecutive months and must not exceed ten (10) months in total;
  • satisfactory knowledge of the Romanian language;
  • must be the holder of a right of temporary residence on the territory of Romania, a right to work or a family reunification right;
  •  no measures of removal from the national territory/the country of origin have been ruled against the applicant.The application for the approval of the long-term right of residence is settled by the Romanian Inspectorate for Immigration within approximately six (6) months. After an affirmative answer is received, the next step is obtaining the long-term residence permit, which will be issued for a period of five (5) years or, for applicants who are family members of Romanian citizens, for a period of ten (10) years.
